The Corporate Counsel (m/f/d) will be a member of the EMEA Legal team, providing cross-regional and global legal support on a wide range of matters. The overall focus of the role will be general commercial legal work, including advising on a wide range of contracts, with a particular focus on intellectual property licensing (both in and out), patent litigation and legal compliance. This role will also require the successful applicant to have substantial experience and knowledge of medical device law and of handling product regulatory matters. The Corporate Counsel will report to the EMEA Regional Senior Corporate Counsel, DACH and work closely with other lawyers in the EMEA Legal team, as well as global Division Counsel across all Thermo Fisher businesses, but particularly Thermo Fisher Scientific’s Speciality Diagnostics Group, to provide high quality, business focused legal advice and assistance. The Corporate Counsel will also work closely with other functions including Finance, Procurement, IP, Quality and Regulatory.

What will you do?
  • Work closely with business partners on commercial and legal strategy, including business development and potential M&A matters, and participate in and advise business unit leadership teams on these areas.
  • Draft and negotiate various agreements for all parts of the organisation in support of their objectives, including IP licensing, sales agreements, strategic supply agreements, distribution agreements, collaboration agreements, co-marketing agreements etc.
  • Manage disputes, working with the litigation team and external counsel where appropriate.
  • Deal with regulatory matters, IVDR implementation projects, field actions, certifications and registrations etc.
  • Deal with a variety of marketing inquiries including MedTech Europe compliance.
  • Take an active role in the Team’s digitalization and harmonization strategy, by supporting and improving existing IT tools and/or supporting the roll-out of new IT tools for the Team.
  • Consult with other parts of the organisation on the interpretation of the agreements in effect or in development.
  • Participate in the resolution of a wide range of business, contractual, financial and operational issues.
  • Educate and train employees on their obligations under the terms of various contracts and under applicable legal requirements.
  • Work with other members of the EMEA Legal team and the various divisions with a presence in EMEA to manage a wide range of commercial contracts, focussing on more complex agreements and covering a broad spectrum of operational business issues.
  • Work collaboratively with Division Counsels across all Groups and on various EMEA matters and initiatives.
  • Ensuring compliance with all applicable laws and the company’s internal guidelines and business codes of conduct with a particular focus on healthcare compliance.
  • Manage outside counsel and related budgets.


How will you get here?
  • Fully qualified as a lawyer in Germany (2nd state exam) from an internationally recognised University/law school. Being comfortable/experienced with delivering legal advice in all of DACH.
  • 5+ years’ experience, preferably in-house or in a full-service international law firm, representing life science, fast moving consumer goods, other relevant regulated-sector companies.
  • Significant working experience (4+ years) for a medical device, pharmaceutical or similar company is highly desirable.
  • Strong working knowledge of the German legal system and experience in domestic and international litigation.
  • Experience in working in an international environment and matrix organization is a plus.
  • Good IT knowledge; interest in dealing with/exploring Legal solutions software.
  • Strong commercial awareness and business sense, including the ability to fully engage with and influence business stakeholders.
  • Strong experience in contract and licence negotiation/drafting and general intellectual property law.
  • Ability to develop practical processes/approaches and to drive solutions to completion.
  • Strong ‘Can Do Attitude’, contributor mentality and high motivation required; ability to deal with an ever changing, complex business environment; excellent communication/negotiation skills, robust and enthusiastic self-starter, excellent team player.
  • Fluent in spoken and written German and English (additional language(s) an advantage).
  • Occasional travel.
