Job Summary

MORTGAGE SERVICING ASSOCIATE OR ASSISTANT GENERAL COUNSEL

You are primarily responsible and accountable for providing core servicing and collections legal support including the recommendation of enhancements to minimize risk and ensure compliance with all state and federal regulations. This role may also support some loan recapture items, as needed, but not primarily. This position is a member of the Legal Department working under the direction of the General Counsel.

PRIMARY DUTIES AND RESPONSIBILITIES:

  • Advise on and assist with compliance matters and projects to ensure compliance with alphabet regulations and laws including RESPA, TILA, FDCPA and TCPA, state loan servicing and debt collection regulations, agency and investor requirements and guidelines and evolving case law
  • Regularly advise business stakeholders on legal requirements and related policies and procedures
  • Subject matter expert in compliance with all federal and state privacy laws
  • Facilitate the Fee Governance Committee and own borrower facing fee schedule
  • Maintain matrix of disclosure requirements in accordance with applicable law, regulations, and agency guidelines
  • Conduct legal research and analysis to provide advice on best business practices
  • Assist with responding to federal and state inquires
  • Advise on legal and regulatory developments in consumer lending and impacts on business activities
  • Review documents for compliance with all applicable laws and regulations
  • Work with business units to resolve loan level legal and compliance issues
  • Ensure all websites utilized follow applicable state and federal laws and regulations

MINIMUM QUALIFICATIONS:

  • Juris Doctorate from an ABA-accredited law school
  • Licensed to practice law in at least one state
  • 5+ years of directly related experience, preferably in a Mortgage Servicing environment
  • Contracting expertise, financial services compliance experience, excellent leadership, and strong communication skills
  • Strong research, analysis, problem-solving and decision-making skills with ability to identify compliance risks
  • Experience with default servicing, including loss mitigation and foreclosure
  • Strong proficiency in Word, PowerPoint, Excel, and Outlook needed
  • Keen attention to detail and excellent analytical ability
  • Prior in-house financial services industry experience, especially mortgage transactions and regulatory experience, a significant advantage
  • Strong project management skills and ability to complete projects with minimal supervision under tight timelines
  • Resiliency, with a sense of humor
